Thunder, Inc of Gilbert, Az Threatens Buggynews.com Administration and Others That Question Carb Certificaiton
Author: Stephen HopkinsRecently there has been a very hot topic on the forums of www.buggynews.com concerning EPA and CARB certification of certain 800cc and 1.6L off road vehicles currently being sold in the state of California. In response to this thread and questions concerning the EPA and CARB certification of certain Joyner off road buggies, John Burns, the owner of Thunder Motorsports (Thunder, Inc.) http://www.thunderinc.com chose to forward a message to one of his network dealers as follows:"Excutive orders are not transferable to a different application. The excutive order is issued to the aplication with exhuast system and fuel system that is going to be used. This is also the epa regs also so if they want to hold this up we will turn them in also. We (Thunder) have all epa certificates allowing us to import and distribute to all states. We have now turned this over to our attorney to pursue action. Our law firm is Sacks Tourney in Scotsdale Az Steve Goldstein 480-425-2600. We are now looking at claims against super karts, moto us, and buggy news admistrators and owners. We have contacted federal epa and also an attorney in CA to pursue a restaining order against the parties to not be at any display or market place we are for their action and the damaging statements that they are continuing to post. We will be very clear to this we will sue anyone and everyone that harms our worthy names by falsehoods and mis information. You can post we will now fight fire with fire and they will not like it very much. To say there is no epa on 800cc we have one and we also have alot more but we will not publish our documents for anyone to see. Call EPA John La Croy I encourage you to post a request that the member of buggy news that owns a sand devil in phoenix can come to my new office and i will allow him and a witness to veiw all our certificates and then he can post it on buggynews for all to see just how hot a wind bag these two guys are. "
Is this how a enviromentally concerned powersports distributor responds to CARB certification requests? Apparantly Mr. Burns feels as though he can simply shut down the buggy community and trample the first amendment at will. If he would take the time to cautiously read the words published by the BuggyNews Administrator, it would be painfully clear that all information is not yet availble, and that requests have been made from EPA and CARB officials to assist make final conclusions as to the legal status of their products in California. Perhaps Mr Burns should be more concerned with providing proof the BuggyNew administration so that they may put this issue decently to rest, rather than spreading around loosely bound legal threats.
